Overview

The Netherlands regulates crypto-asset services jointly through the Dutch Authority for the Financial Markets (AFM) and De Nederlandsche Bank (DNB), and has been among the fastest EU member states to implement the Markets in Crypto-Assets Regulation (MiCA), which took effect on 30 December 2024. Under MiCA, crypto-asset service providers must be authorised as CASPs; the AFM took comprehensive responsibility for CASP licensing, processing and assessing applications as well as ongoing supervision and enforcement, while DNB retains a role in authorisation and prudential oversight. Where most EU countries used MiCA's full 18-month transition, the Netherlands shortened it: the government set a deadline of 30 June 2025 for Dutch CASPs to comply, well ahead of European peers, with transitional provisions allowing firms registered with DNB for anti-money-laundering purposes before 30 December 2024 to continue operating until 31 December 2025. Minimum initial capital depends on the highest-risk activity offered — €50,000 for Class 1, €125,000 for Class 2 and €150,000 for Class 3, which includes operating a crypto-asset trading platform. Firms including Finst and Banxa have obtained Dutch MiCA licences. Before MiCA, Dutch crypto firms registered with DNB for AML purposes. MiCA took effect on 30 December 2024, and the Netherlands opted for a shortened transition ending 30 June 2025 rather than the full 18 months, with pre-existing DNB-registered VASPs permitted to operate until 31 December 2025. The AFM has since granted MiCA CASP licences to firms including Finst and Banxa.
