Overview
Japan's Financial Services Agency (FSA) is the national financial regulator responsible for supervising crypto-asset businesses. Crypto assets in Japan have been regulated principally under the Payment Services Act, which governs registration of crypto-asset exchange service providers, custody of customer assets, stablecoin issuance and anti-money-laundering obligations. The FSA has been preparing a shift that would move crypto-asset regulation to the stricter Financial Instruments and Exchange Act, adding insider-trading rules and disclosure obligations, while stablecoins would remain under the Payment Services Act and NFTs would generally fall outside scope. The FSA has also proposed mandatory cybersecurity requirements for crypto exchanges.
