Overview
Germany is one of the EU's most active crypto jurisdictions, regulated primarily by BaFin, the Federal Financial Supervisory Authority, which licenses and supervises crypto-asset service providers including exchanges and custodians. Since 2025 Germany has applied the EU's Markets in Crypto-Assets Regulation (MiCAR), with national implementing acts introducing transitional provisions: existing German licences remained valid until 31 December 2025 under a grandfathering regime while providers moved to MiCAR-compliant CASP authorisations. Germany has issued more than 30 crypto licences, far more than nearly any other EU member state. Tax treatment is distinctive: cryptocurrencies are treated as 'private economic goods' rather than securities, so capital gains tax as such does not apply; instead disposals fall under income tax at 0-45% depending on total income, with trading gains exempt up to €1,000 per year and staking and mining income exempt up to €256 per year. Crucially, profits from selling crypto held for more than one year are entirely tax-exempt. Germany built an early national licensing regime for crypto custody and trading under BaFin supervision, then transitioned to the EU-wide MiCAR framework in 2025, with grandfathered national licences remaining valid until 31 December 2025.
